Boston DUI Defense Attorney

Cross-Examining Police Officers

If you have been arrested and charged with a DUI (OUI) in Boston, who you choose to represent you as a Boston DUI Defense Attorney is a critical decision.  One of the factors that becomes significant in your defense is the ability to cross-examine police officers.  There are important parts of the police report about your case that can be called into question.  Law enforcement has a habit of continuously writing police reports that claim the accused had "bloodshot eyes", "slurred speech", and "flushed face".

Boston OUI Defense Lawyer - Tough Cross-Examination of Police Officers

These statements come up time after time to give the impression that the accused "looked intoxicated".  All of these statements will be delved into, as they come up so many times that it is often suspected that there are put in the report just as a matter of course, and that they were not actually observed.  After all, a flushed face could be embarrassment, high blood pressure, a rosy complexion, sunburn or skin condition.  Slurred speech could be a language difference, or just the way a certain individual talks.  In many cases, these claims, if the officer is cross-examined, fall apart like a house of cards.

Every aspect of the report made by law enforcement will be thoroughly attacked as to its accuracy.  Many of these reports sound similar, and this can be very productive for the defense.  If the report says that the "vehicle smelled like alcohol", it does not indicate that the driver was intoxicated.  A passenger could have been drinking alcohol, or there could have been something spilled on the clothing of the accused.  It is not proof that the driver is actually intoxicated.  It is crucial that you have a tough trial lawyer fighting aggressively for you on any DUI charge, and a cross-examination of the reporting officer is part of that process.
