There is also the defense related to the accuracy of the breathalyzer testing device.  These devices are notorious for having incorrect readings or for being incorrectly maintained, resulting in a inaccurate reading.  To add to this, the device is known for being approximately 15% wrong in 23% of cases when measured against actual blood alcohol readings.  This means there is a large margin of error for those who "blew" just above the limit.  The likelihood that they were not above the limit is actually quite strong. 

Dealing with the police report is another defense tactic that is often very productive for the accused.  These reports may contain statements that make it sound as if the accused was intoxicated, such as slurred speech, bloodshot eyes and flushed face.  There are so many other reasons that an individual may have any of these physical manifestations (if they actually even had them) that this can easily be questioned and challenged in court.
