Out-of-State Offenses

Massachusetts laws treat out-of-state DUI convictions as if they occurred within the state.  This can create a very serious problem for an individual who is applying for a driver's license in Boston, as the NDR (National Driver's Registry) will be searched for your name, and if a DUI conviction is found on your record, you may be denied your driver's license.  This is also true if you currently have a Massachusetts driver's license and your name comes up on this nationwide registry, your license will likely be immediately revoked.  This can set you up for some real confusion if you have moved and don't receive the notice of suspension.  The next time you are stopped by law enforcement you will likely be charged with driving with a suspended license which is a very serious offense.

How to handle an out-of-state offense

If you have an out-of-state DUI conviction, you will have to jump through some legal hoops in order to get your license in Massachusetts reinstated.  You will first have to clear up the charge in the state where you received it.  You will need a "reinstatement and clearance letter" not more than 30 days old and submit this to the RMV.  You will need your driving record from the other state, also no more than 30 days old.  If your license was suspended or revoked due to DUI charge in the other state, you may be required to submit a court abstract from the case.
